RENTAL AGREEMENT / TERMS AND CONDITIONS
Please ensure you read and understand the following terms and conditions pertinent to your accommodation rental. If you have any questions, please do not hesitate to contact us.

While we reserve the right to increase or decrease accommodation prices at any time, we will confirm to you the current price at the time of booking. As soon as you have confirmed your booking and paid your deposit or full payment, the cost of the rental is guaranteed against any increase, (unless these increases are brought about by Government action or there was a clear clerical/system error). This guarantee is offered subject to our conditions of payment being adhered to and providing you do not make any further amendments to your travel arrangements.

There are no additional fees in addition to the rental amount, taxes, and cleaning fee outlined on the booking screen. For instance, use of the pools & gym, pool bands, parking, etc are all included. Beach Service is offered as an optional add-on that you may choose at booking.  If selected, your service reservations will be taken care of for you prior to your stay.


ARRIVAL AND DEPARTURE:

A. CHECK-IN:
Check-in time is any time after 4:00 p.m. We reserve the right to extend check in time to 6:00 p.m. due to cleaning or required maintenance although this is extremely rare. While we cannot guarantee an early check-in, we do stay in constant contact with our housekeeping teams and will notify you if your condo is ready early.

Upon Arrival, you may head straight up to the condo and use the code provided for the KABA Keyless Door Lock. The code activates at the Check-in Time and will work for the duration of your stay. To be clear, there is no need to check-in at an office or drive across town to pickup keys. We have tried to our best to make the beginning of your vacation as stress-free as possible.

B. CHECK-OUT:
Check-out time is any time before 10:00 a.m. Simply follow our basic checkout procedures and have a SAFE trip home. Failure to comply may result in an additional charge for late departure. If another guest is not checking in on the same day, a Late Checkout request can be made 24-48 hours before the scheduled checkout. Please understand that these requests are difficult to accommodate and a late checkout fee will likely apply.


BOOKING AND PAYMENT:

A. PAYMENT:
Payment must be made in U.S. funds. We accept Visa, Mastercard, Discover, American Express, and Paypal.  ALL BOOKINGS MUST BE SECURED WITH A CREDIT CARD. If a credit card is unavailable, the reservation cannot be taken. Payments are to be made according to the payment schedule on your reservation confirmation. Guest’s credit card will be charged the total due if payment is not received 30 days prior to check-in date.

B. BALANCE:
The balance of the rental fee is due 30 days prior to the commencement of the rental period. You will receive an email reminder 3 days prior to the due date. While we will make every attempt to get in contact with you first, but we reserve the right to treat the booking as cancelled if we do not receive the balance by the due date.

D. SECURITY DEPOSITS:
615GoneCoastal requires a valid credit card number be kept on file. This card serves as a replacement for a refundable security deposit. As long as the following conditions are meet, no additional charges will be applied to your credit card.
1. No damage is done to unit or its contents, beyond normal wear and tear.
2. No charges are incurred due to contraband, pets, or collection of rents or services rendered during the stay.
3. All debris, rubbish and discards are placed in dumpster, and soiled dishes are placed in the dishwasher and cleaned. The laundry of one load of towels is started.
4. The unit is left locked.
5. All charges accrued during the stay are paid prior to departure.
6. No linens are lost or damaged.
7. Any moved furniture is moved back into place as it was found.
8. NO Early check-in or late check-out.
9. The renter is not evicted by the owner (or representative of the owner),
the local law enforcement, or the security company employed by the resort.

E. CANCELLATION INSURANCE:

615GoneCoastal encourages out guests to purchase travel insurance. Travel Insurance provides coverage for personal risks and expenses incidental to planned travel, including one or more of the following:

  • Interruption, delay, or cancellation of a Planned Covered Trip
  • Loss of or damage to baggage, luggage, or personal effects during a Planned Covered Trip or Event
  • Damage to accommodations or rental vehicles
  • Injury, illness, accident, disability, or death occurring during a Planned Covered Trip

TERMS AND CONDITIONS:

A. ADDRESS:
The address of your vacation property is on the Booking Confirmation and in the Pre-Arrival Information.

B. OCCUPANTS:
Only those designated in this agreement as GUEST shall occupy the unit unless WRITTEN CONSENT OF Owner or Owner’s agent is obtained. Guest agrees to abide by all occupancy rules of the resort’s association or other governing agency. Maximum occupancy is stated in the property description.

C. ACCOMMODATIONS:
Due to circumstances beyond our control (e.g. fire, flood), if your designated unit is not available for any reason, we will use our best efforts to locate a comparable substitute unit. In the event a substitute unit is not available, Guests agrees to hold Owner, Broker its agents and representatives harmless for any damages, costs or inconveniences suffered and Guest shall receive a full refund of any and all amounts paid.

D. ALTERATIONS TO BOOKINGS:
If, after your booking has been accepted, you wish to alter your arrangements, we will do all we can to help, however an administrative fee of up to $50.00 per booking may be charged.

E. CANCELLATION TERMS:
A sixty (60) day notice is required for cancellation of short term reservations of 24 nights or less. Cancellations on short term reservations that are made more than sixty (60) days prior to the arrival date will incur no penalty.

All reservations of 24 nights or longer are considered monthly rentals and are non-refundable. Any advance payments made on monthly rentals will not be refunded if the guest chooses to cancel regardless of how much notice is provided.

Early departure does not warrant any refund of rent.

Owner may cancel this agreement at least 120 days prior to check-in date, and all advance funds will be refunded to tenants. 615GoneCoastal shall not be responsible for any costs Guests may incur for travel or other arrangements in the event of cancellation by Owner or Guests.

F. HURRICANE POLICY:
In order to secure a refund in the event of a Hurricane, you must purchase Travel Insurance. Otherwise, no credits or refunds will be guaranteed.

You must read and understand the fine print and coverage of the Travel Insurance policy as it varies by your state of residence, however it generally seems to cover you under the following circumstances:

  • A mandatory evacuation has been issued for the county where the rented property resides.
  • There is an interruption of utilities (water, electric, sewage, or gas service) at the property for more than 24 hours.
  • There is an interruption of road service for 24 hours or more that prohibits you from reaching the property.
  • The property is inaccessible/cannot be reached by your original mode of transportation.

G. ASSOCIATION RULES AND REGULATIONS:
Anyone occupying a unit governed by a homeowners or condominium association shall abide by all association rules and regulations. Guest agrees to indemnify and hold Agent harmless from any liability from injury to person, violations of the rules of the association, damage to the unit by guests, or non-availability.

H. PETS:
Pets are NOT permitted. A charge of $500 will be assessed to the Guest if a violation occurs and an unauthorized pet is found on the premises. 

I. SMOKING:
Smoking is NOT permitted at any time in the rental unit. A charge of $500 will be assessed to the Guest if a violation occurs and smokes in the unit.

J. PARKING:
No boats, motor homes, trailers, or commercial vehicles shall be permitted on the premises.

K. CLEANING CHARGES:
Guest agrees to pay any additional cleaning charges incurred. Guest shall clean all dishes and remove all food from the premises upon cheek out. One towel per guest and bed linens are the only acceptable unwashed laundry items allowed left in the unit. All garbage must be removed. Guest shall NOT be responsible for making up beds at checkout. Guest gives authorization to charge cleaning charges to the Security Deposit if the Rental Manager determines, in its sole discretion, that excessive dirt, furniture stains, carpet stains or other damage is present, additional charges will be assessed and charged to the Security Deposit.

L. MAINTENANCE:
Owner shall be responsible for maintaining the unit unless damage is caused by Guest(s) misuse or neglect. Guest agrees that no rent reduction or abatement will be given unless unit is deemed to be completely uninhabitable. Guest may not make any changes to the unit and must put furniture back to its original placement (if moved). Rental Manager will order repairs in a timely manner once notification is given by the Guest. Any work performed in the unit or buildings, nearby buildings grounds or common amenities is not reason for refund or cancellation of this agreement after check-in date. Any damages or problems found upon arrival should be reported immediately to the rental manager within 24 hours of occupancy.

M. ASSIGNMENT:
Guest shall not assign this agreement or sublet the premises or any part thereof. Any unauthorized transfer of interest by the tenant shall be a material breach of this agreement.

N. INDEMNIFICATION:
Guest agrees to indemnify and hold harmless owner and rental manager from claims, suits, or damages of any kind, from or related to any acts or omissions of guest or guest(s) gross negligence.

O. RISK OF LOSS:
The homeowner and/or 615GoneCoastal will not be held liable for any accidents or injury to guests while staying in the vacation rentals. Personal property of guests and guest’s invitee’s shall be in the unit at the sole risk of the guests. 615GoneCoastal and homeowner shall not be liable for the loss of money, jewelry, valuable possessions of any kind and/or any damage caused to said personal property arising from fire, accident, acts of God, criminal acts, acts of negligence or bursting or leaking water pipes.

P. ATTORNEY FEES:
Should it become necessary for owner or rental manager to employ an attorney to enforce the terms and conditions of this agreement, TENANT SHALL be responsible for all cost and attorneys fees whether or not suit is filed.

GUEST ACKNOWLEDGES AND ASSERTS THAT THIS PROPERTY IS NOT THEIR SOLE RESIDENCE, AND GUEST INTENDS THIS OCCUPANCY TO BE TEMPORARY AND TRANSIENT. GUEST ACKNOWLEDGES FLORIDA STATUTE CHAPTER 509 WILL APPLY AND REGULATE THE OCCUPANCY. INITIAL DEPOSIT OF MONEY SHALL CONSTITUTE VALID BINDING ACCEPTANCE OF THIS AGREEMENT. GUEST ACKNOWLEDGES THAT THE ABOVE STATEMENTS HAVE BEEN READ, AND GUEST AGREES TO ABIDE BY THEM.
